Türkiye's VDK Overseas Income Monitoring Program: Legal Basis, Decision Timeline and Asset Peace
Türkiye's Tax Inspection Board combines CRS and CbCR data with tax returns and domestic records under its Overseas Income Monitoring Program. This guide explains the legal framework, the stages a taxpayer may face, and the limited connection with Türkiye's 2026 Asset Peace regime.

Legislative note: This article reflects the law and official materials checked through 12 October 2026. It is based on Articles 5, 114, 140, 148, 149, 152/A, 370 and 371 and repeating Article 257 of the Tax Procedure Law (Vergi Usul Kanunu, VUK); Articles 3, 4, 5, 85 and 123 of the Income Tax Law (Gelir Vergisi Kanunu, GVK); Articles 5, 7, 13 and Temporary Article 19 of the Corporate Tax Law (Kurumlar Vergisi Kanunu, KVK); and the Asset Peace Communiqué. The VDK announcement dated 28 September 2026 was checked against the official portal record: https://vdk.hmb.gov.tr/haberler/yurtdisi-kazanclar (accessed 12 October 2026). CRS, CbCR and FATCA coverage must also be checked against the relevant agreements, activation records and secondary legislation.
The main general provisions that may support the program are VUK Articles 148, 149 and 152/A for requesting and collecting information, and repeating Article 257 for electronic procedures and formats. VUK Article 5 defines tax confidentiality and a limited boundary for data sharing between public bodies; it does not independently authorise access to data. KVK Temporary Article 19 is not the legal basis of the monitoring program. It is a separate and optional Asset Peace regime for persons who meet its conditions.
The Program in 60 Seconds
- VDK announced the program in September 2026. It evaluates CRS, CbCR, tax returns, domestic data and Risk Analysis Centre findings together. The first contact is an information or explanation request. The announcement does not define every later step as an automatic sequence.
- The core domestic provisions are VUK Article 149, Article 152/A, repeating Article 257(1)(4), and the limited confidentiality exception in Article 5.
- CRS requires both a reportable account and an active exchange relationship. CbCR applies only to multinational enterprise groups above the applicable threshold. FATCA reciprocity depends on the IGA and US domestic reporting rules.
- Notifications under KVK Temporary Article 19 may be made until 31 July 2027. A monitoring letter or the authority’s awareness is not by itself the statutory cut-off. Protection is unavailable for an assessment arising from an audit or assessment-commission referral that began before the notification.
What the Official Announcement Says
The official VDK portal record confirms the announcement date and three central features:
- international exchange data, particularly CRS and CbCR, are assessed together with taxpayer returns, domestic data sources and Risk Analysis Centre findings;
- the initial analysis concerns taxpayers described as having a high-income and high-wealth profile, including their foreign financial assets, investments, company and ownership structures, and overseas income and gains; and
- taxpayers selected for monitoring are served with a notice by tax inspectors and asked to provide information or an explanation about the identified matters.
The official announcement does not mention FATCA or crypto assets. It describes the program mainly through CRS and CbCR. The announcement also does not establish whether a particular letter is an invitation to explain under VUK Article 370, an information request under Article 148, or another administrative communication. The correct legal classification depends on the stated legal basis, the request, the deadline, the issuing authority and the annexes.
Domestic Legal Framework
The provisions below are general rules that may be relevant to the program. The legal character of an actual notice must still be determined from that notice. Asset Peace under KVK Temporary Article 19 is addressed separately because it is an optional regime, not the program’s legal foundation.
VUK Article 152/A — exchange under international agreements
VUK Article 152/A authorises the Revenue Administration or officials empowered to conduct tax audits to collect information within the exchange-of-information provisions of duly effective international agreements.
The phrase allowing collection beyond the scope described in VUK Article 1 concerns the statutory subject-matter scope of taxes, duties and charges. It should not be reduced to a simple geographical rule. Article 152/A is the domestic-law anchor for collecting information under international agreements; the agreement and its activation arrangements still define the actual exchange.
VUK Articles 148 and 149 — information and periodic reporting
Article 148 is the general power under which the Ministry of Treasury and Finance or authorised tax-audit officials may request information. It may be used before or during an audit.
Article 149 is the general rule for information that public bodies and natural or legal persons must provide in writing, periodically and continuously, when requested for taxation purposes. Electronic reporting still requires secondary rules that define the persons, periods, content, format and procedure. Article 149 alone does not prove that every bank, broker, platform or crypto-service-provider record is transferred automatically and continuously.
VUK repeating Article 257(1)(4) — electronic formats
Repeating Article 257 authorises the administration to require information, returns, notices, petitions, minutes, reports and other documents to be delivered through electronic communication environments, including the internet, using passwords, electronic signatures or other security tools. Systems such as BTRANS, the Digital Tax Office and E-Declaration rely on this type of authority, while the relevant communiqués and procedural rules specify the actual dataset and reporting population.
VUK Article 5 — the confidentiality exception
The paragraph added to Article 5 by Law No. 7103 permits information to be supplied to public bodies without breaching tax confidentiality where that information may be requested under the body’s own governing law, is directly related to its duties, and is necessary and continuous for performing them.
This is a limited confidentiality exception, not a general power to access or share tax data. The recipient’s own statutory power, direct relevance to its duties, necessity and continuity must each exist.
CRS, FATCA and CbCR in brief
CRS is in force for Türkiye. For new accounts, reportability is generally determined using self-certification; existing accounts may also be reviewed through electronic records and tax-residence indicia. Automatic transmission requires an active exchange relationship for the relevant period, and the data fields vary by account type. The OECD AEOI Portal should be used to check the current partner relationship.
The Türkiye-US FATCA IGA is also in force, but the information that may flow from the United States to Türkiye depends on the IGA’s exchange provision and US domestic reporting rules. FATCA is not equivalent to CRS. A US brokerage account, RSU or stock-option record must be checked against the particular account and data category.
Country-by-country reporting applies only to multinational enterprise groups above the applicable threshold. Türkiye’s filing and exchange timetable should be checked against the Revenue Administration’s rules and the OECD CbCR MCAA activation records.
Tax treaties — a separate exchange channel
Exchange of information and the mutual agreement procedure are separate treaty provisions. Because numbering and scope differ between Türkiye’s treaties, the actual exchange article must be reviewed for covered persons, taxes, periods and entry into force.
A double tax treaty or another exchange instrument may support exchange on request and, where the conditions are met, spontaneous exchange. Automatic exchange additionally requires a competent-authority arrangement, activation and an active relationship. A general treaty clause does not by itself prove an automatic flow.
How Data May Reach the Taxpayer
The following table separates the authority’s incoming data channel from the document that a taxpayer may actually receive. BTRANS is an administrative data-transmission infrastructure; it is not a taxpayer-facing screen.
| Data source | Channel to the authority | Stage visible to the taxpayer | Main legal framework |
|---|---|---|---|
| Foreign financial account | CRS automatic exchange, subject to a reportable account and active relationship | Information or explanation request after risk analysis; invitation to explain only if Article 370 conditions are separately met | VUK Article 152/A and CRS instruments |
| Information covered by the Türkiye-US FATCA framework | IGA exchange provision and US domestic reporting rules | Written information or explanation request | VUK Article 152/A and the FATCA IGA |
| Information requested under a tax treaty | The treaty’s exchange-of-information article | Internal risk analysis, followed where appropriate by a written request or procedural step | VUK Article 152/A and the relevant treaty |
| CbCR data for a multinational group | CbCR MCAA and domestic filings for in-scope groups | Possible Master File, Local File or additional-document request if transfer-pricing risk is identified | KVK Article 13, CbCR rules and VUK Article 152/A |
| Domestic information-reporting systems | VUK Article 149 plus source-specific secondary rules | Internal risk analysis followed by a formal notice or document | VUK Article 149, repeating Article 257 and the relevant communiqué |
| Bank evidence for domestic payment-verification rules | Documentary-verification powers under repeating Article 257 | Bank records may be requested during an information request or audit | VUK repeating Article 257(1)(2) |
| Customs declaration for an asset physically brought into Türkiye under Asset Peace | Customs declaration, later reported to the Revenue Administration | Evidence that the asset was brought into Türkiye and deposited in the required account | KVK Temporary Article 19(2) |
Three limits matter. Not every account is automatically reported to Türkiye; not every multinational group is within CbCR; and FATCA reciprocity is narrower and structurally different from CRS. Taxpayers also do not ordinarily see the underlying risk data directly in the Digital Tax Office. They see the formal document served on them: an information request, an invitation to explain, a notice that an audit has commenced, or another e-notification.
Taxpayer Profiles and First Questions
This matrix is not an official VDK classification. It shows which legal and factual questions should be addressed first for recurring profiles.
| Taxpayer profile | Questions to examine | Legal framework |
|---|---|---|
| Income through Upwork, Fiverr, Toptal or another foreign platform | Where was the activity actually performed? What is the legal character and source of the income? Payment through a foreign platform or bank does not automatically make a service performed in Türkiye foreign-source income. | GVK Article 85 only where its conditions are met, plus a fact-specific source analysis |
| RSUs or stock options held through a foreign broker | Vesting, entitlement, sale, transfer to Türkiye, employment relationship and ability to dispose of the benefit must be read from the plan documents. | GVK rules for employment income and capital gains, applied to the plan |
| Transactions on a foreign crypto exchange | Bank transfers, exchange records and wallet records must be read with Türkiye’s current crypto-asset legislation. Asset Peace treatment is limited by the statutory asset categories. | KVK Temporary Article 19 scope analysis and domestic crypto rules |
| Foreign individual resident in Türkiye | Full tax liability must be tested under GVK Articles 3, 4 and 5, including the cases that do not constitute residence. A treaty tie-breaker and its exchange article serve different purposes and must be analysed separately. | GVK Articles 3–5, the relevant treaty and CRS |
| Foreign subsidiary income of a Turkish company | The conditional participation exemption and controlled foreign company rules must be read together. CbCR is relevant only for groups above the threshold. | KVK Articles 5(1)(b), 7 and the CbCR rules |
| Foreign account during a change of residence | Immigration dates, domicile, tax-residence certificates, account statements and payment dates should be used to separate income before and after the residence transition. | GVK Articles 3–5 and the treaty residence article |
Transmission of CRS data requires both an active exchange relationship and a reportable account. Receipt of data does not by itself determine the tax year. The income source and category, the specific realisation rule, receipt or control, and the wording of GVK Article 85 must be evaluated together.
GVK Article 85 — Income Earned in a Foreign Country
Article 85 governs annual returns and aggregation of income. For income and gains earned in foreign countries, the statutory rule treats them as earned:
- in the year in which they are transferred to the taxpayer’s accounts in Türkiye; or
- where non-transfer results from circumstances beyond the taxpayer’s control and is documented, in the year in which the taxpayer is able to dispose of them.
The scope of “transferred to the taxpayer’s accounts in Türkiye” and any category-specific income rule must be examined in the facts of each case. The two statutory limbs cannot simply be ignored. An inventory should therefore record the transfer date and the evidence of any obstacle beyond the taxpayer’s control separately.
Once the declaration year is established, a fully liable individual should test the foreign tax credit under GVK Article 123. The foreign levy must be a personal tax imposed on income, and the competent-authority document is generally subject to Turkish consular certification. In a private ruling dated 19 December 2025, numbered E-34566971-120-41183, the Kastamonu Revenue Management and Audit Directorate concluded that additional consular certification was not required where US withholding was evidenced by an apostilled IRS Form 1042-S.
That conclusion belongs to the facts, income type and evidence chain of the ruling and should not be generalised. If the document has not arrived by the payment instalment, the relevant portion of tax may be deferred for one year. If it is not produced in that period, the deferral ends and a later submission does not revive the credit. VUK force-majeure rules remain reserved. Companies must examine the Corporate Tax Law’s foreign-tax-credit rule and the relevant treaty separately.
Relationship with the 2026 Asset Peace Regime
Temporary Article 19 was added to the Corporate Tax Law by Article 10 of Law No. 7582, dated 21 May 2026, and entered into force on 4 June 2026. The General Communiqué on Bringing Certain Assets into the Economy (Serial No. 1) supplies the implementation rules. This is commonly called the eighth Asset Peace regime.
The core mechanics are:
- Foreign assets: cash, gold and foreign currency are notified to banks; securities and other capital-market instruments to banks or brokerage firms, by 31 July 2027. Assets brought by transfer must be moved within two months to an appropriate account opened in the notifier’s name. Physically imported assets require completion of customs formalities within two months and deposit by the end of the next business day after those formalities.
- Unrecorded domestic assets: income-tax and corporate-tax taxpayers may notify eligible assets absent from their statutory books by 31 July 2027. Unlike foreign assets, the two-month period does not apply; the asset must already have been deposited with a bank or broker as of the notification date, and this must be evidenced. Conditions for persons without an income- or corporate-tax registration are examined separately under paragraph 5.
- Upfront tax: the standard rate is 5%. A commitment to hold eligible time deposits, government debt, lease certificates or venture-capital funds reduces the rate to 4% after one year, 3% after two, 2% after three, 1% after four and 0% after five years. Notifications from 1 January through 31 July 2027 add 0.5 percentage points; an extension of the filing period may add a total of one point.
- Book treatment: taxpayers keeping books under VUK record the assets as of the notification date. Balance-sheet taxpayers open a special reserve on the liabilities side on that date. The reserve may not be withdrawn for two years and, during that period, may be used only for a capital increase. Self-employed and business-account taxpayers show the assets separately in their books.
- Protection under paragraph 8: no tax audit or assessment is made for amounts attributable to notified assets, without prejudice to measures required under other legislation. In an audit begun for another reason, a difference in taxable base is protected only to the extent it is found to arise from the notified assets. If the notified amount is lower than the difference, only the excess remains assessable. The causal link must be established in the actual case.
- Cut-off and conditions under paragraph 9: a notification filed after an audit begins or after referral to the assessment commission does not protect the assessment arising from that audit or referral. Protection is also lost if the transfer, deposit, evidence, timely payment, holding commitment or other statutory conditions are not met.
- Correction limit: once the notification period ends, the notification cannot be corrected. Asset category, valuation, notifier and account details should be checked before the deadline.
A monitoring letter or the authority’s prior awareness does not automatically end protection. The statutory cut-off is the start of a tax audit or referral to the assessment commission. A monitoring letter or an invitation to explain is not, merely by its label, the written notice that an audit has commenced. The actual file should be checked for the notice issued under VUK Article 140(1), its date and subject matter, and for the date of any assessment-commission referral.
Asset Peace is not a general amnesty for all undeclared historical income. It is conditional protection for amounts attributable to a notified asset. The asset must be eligible, and the notification, transfer or deposit, tax payment, holding commitment and other conditions must be met. For a tax-base difference found for another reason, the authority must also find that the difference arose from the notified asset. The law does not establish explanation or proof of the asset’s source as an independent, general eligibility condition. Any comparison with voluntary disclosure under VUK Article 371 depends on the asset, income period, procedural stage and available evidence.
Gökay Gül’s note: CRS does not mean that every foreign account automatically reaches Türkiye. Self-certification or residence indicia, the account type and the active exchange relationship work together. Build an account-by-account, period-by-period inventory, reconcile it to filed returns, and compare voluntary disclosure, Asset Peace and correction options for any gap. There is no single best route for every file.
Four Common Risks
1. “No new tax law means the income is invisible.” The general rules governing declaration of foreign income were already in force. The program does not create a new tax charge. It combines CRS, CbCR, returns and domestic data for risk analysis and permits the authority to request information or an explanation in a selected file.
2. Limitation-period shortcuts. The assessment limitation period is calculated separately for each tax period under VUK Article 114, subject to special suspension or extension rules. For calendar-year individual income tax, and absent a special rule, the general five-year period for 2021 expires on 31 December 2026. The 2026 period is still the current year. Each period needs its own timeline.
3. Misreading a tax treaty. First identify the relevant income article, Türkiye’s taxing right and the treaty method for relieving double taxation. Where Türkiye may tax and the credit method applies, an individual examines GVK Article 123 and a company examines the Corporate Tax Law’s foreign-tax-credit rule. “There is a treaty, so I did not declare” is not a complete position.
4. Confusing account balance with taxable base. A CRS year-end balance is not itself a tax base. Interest periods, opening and closing balances, exchange rates, vesting, sale and transfer dates must be reconciled to evidence.
Frequently Asked Questions
What is the VDK Overseas Income Monitoring Program?
It is the program announced by VDK on 28 September 2026 to combine international exchange data, tax returns and domestic information in risk analysis. Taxpayers selected for monitoring may receive a request for information or an explanation.
Does every foreign account automatically reach Türkiye through CRS?
No. Reportable-account status is determined through self-certification or review of an existing account, and an active exchange relationship with Türkiye must exist for the relevant year.
Are a US brokerage account, RSUs or stock-option sales reported to Türkiye under FATCA?
There is no reliable blanket answer. FATCA reciprocity differs from CRS. The IGA, its annexes and US domestic reporting rules must be checked for the actual account and data category.
How is income from Upwork, Fiverr, Toptal or another foreign platform treated?
The place where the service was performed, the legal character of the income and its source must be determined. A payment from a foreign platform or bank does not by itself make a service performed in Türkiye foreign-source income.
When are foreign stock-option or RSU benefits declared?
Vesting, entitlement, sale and the moment of actual control depend on the plan. The plan terms, employment relationship, vesting schedule and ability to dispose of the benefit must be read together.
Will the authority send an invitation to explain, an information request or an audit notice?
The announcement does not classify the letter. An invitation under Article 370, an information request under Article 148 and written notice that an audit has begun are different procedures. Read the legal basis, demand, deadline, issuing authority and annexes.
Can voluntary disclosure under VUK Article 371 still work if the income appeared in CRS data?
Article 371 contains distinct procedural barriers, including a recorded third-party report concerning the same matter before disclosure, and commencement of an audit or referral for assessment for the relevant tax type. An invitation to explain also prevents Article 371 relief for the preliminary finding covered by that invitation. A routine Article 148 information request is not itself an audit-commencement notice. The statutory 15-day filing, correction and payment requirements must also be met.
How should Asset Peace and the VDK program be compared?
Identify four things: the source and period of the undeclared income; the eligible asset under Temporary Article 19; whether protection concerns the notified asset itself or a tax-base difference found for another reason; and whether an audit or assessment-commission referral has already begun. The answer is file-specific.
Ten-Step Response Plan
- Build one inventory. Record the period, country, institution, account or asset, income type, vesting, sale and control dates, transfer to Türkiye, foreign tax, return line and evidence.
- Separate income by period and category. Interest, dividends, rent, services, RSUs, stock options and sale proceeds can follow different realisation rules.
- Reconcile to returns. Show the filing treatment of every item, the individual foreign-tax-credit rule, the corporate rule and the treaty method separately.
- Calculate limitation periods period by period. Apply Article 114 and any suspension or extension to each tax year independently.
- Compare remedies by period. For voluntary disclosure, test every procedural barrier and the 15-day requirements. For Asset Peace, test the link between the notified asset and any tax-base difference.
- Confirm the Asset Peace asset category. Cash, gold, foreign currency, securities and capital-market instruments are covered; real property is not. Match an ownership interest to the Communiqué definitions.
- Map the Asset Peace calendar. The deadline is 31 July 2027; rates rise by 0.5 points after 1 January 2027. Check holding periods, deposits, transfers and the post-deadline correction ban before filing.
- Archive the CRS or CbCR evidence. Save the OECD AEOI Portal result with the country, first exchange year and query date, and document the reportable-account analysis.
- Classify the notice. Use its legal basis, request, deadline, issuing authority and annexes to distinguish an information request, invitation to explain and audit-commencement notice.
- Create an annual review calendar. Update income categories, realisation dates, exemptions, filing thresholds and evidence at each year-end.
